SUBJECT MUST PREPARE EPP

Subjects which must prepare EPP are specified in column (5) Appendix II, Section I, Appendix of the Government’s Decree No. 40/2019/ND-CP dated May 13, 2019, amending and supplementing a number of articles of the Decrees detailing and guiding the implementation of the Law on Environmental Protection.

  • New investment projects, project for extension of scale or capacity with the total scope and capacity of ongoing facilities and new investment portion prescribed in Column 5 Appendix II of this Decree;
  • Projects/plans for business investment, projects/plans for extension of scale or capacity of business facilities which produce wastewater from 20m3/day (24 hours) to under 500m3/day (24 hours) or solid waste from 1 tonne/day (24 hours) to under 10 tonnes/day (24 hours) or emission from 5,000m3/hour to under 20,000m3/hour (including ongoing facility and extension) other than business investment projects prescribed in Column 3 Appendix II Section I issued together this Decree.

TIME FOR PREPARATION OF EPP

Under the provisions of Clause 11, Article 1, Decree 40/2019/ND-CP (amending and supplementing Article 18, Decree 18/2015/ND-CP), EPP must be registered by the authority agency before the time of implementing or constructing projects for production, business and service.

REGISTRATION AUTHORITY AGENCY OF EPP

According to Clause 12, Article 1, Decree 40/2019/ND-CP (Amending Clause 1, Article 19, Decree 18/2015/ND-CP), depending on the location and scale of the project,  registration authority agencies of EPP include:

  • Provincial specialized agency for environmental protection; or
  • District People’s Committee.

CONTENTS OF EPP

Under the provisions of Clause 11, Article 1, Decree 40/2019/ND-CP (amending and supplementing Clause 3, Article 18, Decree 18/2015/ND-CP), the contents of an EPP include:

  • The description section includes contains as prescribed in Article 30 of the Law on Environment Protection, and basic design or construction drawing design (if the project only requires one single design step) for waste treatment works (if the construction of waste treatment work is required as prescribed) in accordance with law on construction; and a plan for prevention and response to environmental incidents during the construction process and operation process, meeting the environment protection requirements as prescribed;
  • Regarding projects/plans for extension of scope or capacity of ongoing business facilities, the environmental protection plan must contain an evaluation of performance of environment protection of the existing facility; an evaluation of environmental impacts the existing facility and the project/plan for extension of scope or capacity.

Under the provisions of Clause 12, Article 1, Decree 40/2019/ND-CP (amending and supplementing Clause 2, Article 19, Decree 18/2015/ND-CP), the structure and specific content of the EPP are regulated according to the Form No. 02, Appendix VII, Section I of the Appendix issued together with Decree 40/2019/ND-CP as follows:

  • CHAPTER I: SUMMARY DESCRIPTION OF THE PROJECT/PLAN OF PRODUCTION, TRADING, SERVICES. General information about project/plan of production, business and service; Used raw materials, fuels and products of the project; Details of the project’s work items; Environmental status of the project area …
  • CHAPTER II: ENVIRONMENT IMPACT ASSESSMENT OF THE PROJECT; FORECAST DISCHARGED WASTE TYPES AND ENVIRONMENTAL PROTECTION STRUCTURES AND MEASURES. Forecasting the impacts and proposing environmental protection measures for construction and operation phases of the project; proposing environmental protection works and measures for each phase of the project.
  • CHAPTER III: IMPLEMENTATION ORGANIZATION OF ENVIRONMENTAL PROTECTION MEASURES. The plan to organize the implementation of environmental protection measures, the environmental monitoring plan.

PROCESS FOR PREPARATION AND REGISTRATION OF EPP

The process for registration of EPP includes:

  • Step 1: Collect and review project documents;
  • Step 2: Survey the project area;
  • Step 3: Draft EPP;
  • Step 4: Submit EPP to the project owner, edit EPP as comments of the project owner;
  • Step 5: Submit EPPs to the authority agency;
  • Step 6: Complete EPP as recommendations of the authority agency and submit the final EPP to the authority agency;
  • Step 7: Registration of EPP.
